TributeCast.NZ Terms and Conditions

1. Acceptance

By placing an order with TributeCast.NZ (“we”, “our”, or “us”), you agree to these Terms and Conditions.

2. Services

TributeCast.NZ provides professional funeral and memorial livestreaming and recording services throughout New Zealand.

Services may include:

  • Livestreaming of funeral or memorial services;

  • Multi-camera coverage;

  • Recording and replay access;

  • Downloadable recordings (where included);

  • Dedicated memorial webpages (where included);

  • Tribute messages and photo galleries (where included);

  • Associated video production services.

The services provided will depend on the package selected at the time of booking.

3. Booking and Payment

Bookings are confirmed once full payment has been received.

Prices are quoted in New Zealand Dollars (NZD) and include GST unless otherwise stated.

We reserve the right to decline or cancel a booking where reasonably necessary. If TributeCast.NZ cancels a booking before the service is provided, a full refund will be issued.

4. Customer Responsibilities

The customer agrees to:

  • Provide accurate information regarding the venue, service time, contact details and any special requirements.

  • Obtain all permissions and approvals required from the family, funeral director, celebrant, officiant, church, venue, crematorium, cemetery, marae or any other relevant party for TributeCast.NZ to attend, film, record and livestream the service.

  • Ensure TributeCast.NZ has reasonable access to the venue, including suitable locations for cameras and equipment where filming can be carried out safely and without obstruction.

  • Advise the venue and relevant parties that TributeCast.NZ has been engaged to provide livestreaming services and ensure our personnel are permitted to enter and operate at the agreed times.

  • Inform TributeCast.NZ of any venue restrictions, health and safety requirements, cultural protocols, photography or filming restrictions, or any other conditions that may affect the services provided.

  • Notify TributeCast.NZ as soon as reasonably possible of any changes to the service location, date, time or arrangements.

If TributeCast.NZ is unable to provide the agreed services due to a lack of required permissions, restricted access, inaccurate information supplied by the customer, or directions from authorised persons preventing filming or livestreaming, this will not constitute a failure by TributeCast.NZ to provide the services, and any applicable fees will remain payable.

5. Livestream Quality

TributeCast.NZ uses professional broadcast equipment and, where possible, our own dedicated 4G/5G internet connectivity.

However, livestreaming relies on factors outside our reasonable control, including:

  • Mobile network availability and signal strength;

  • Internet congestion;

  • Venue restrictions;

  • Weather conditions;

  • Power outages;

  • Equipment supplied by third parties;

  • Third-party streaming platforms and hosting services.

While every reasonable effort is made to provide uninterrupted livestreaming and recording, TributeCast.NZ cannot guarantee that technical interruptions, reduced video quality or service failures will never occur.

The quality, positioning or continuity of the livestream may also be affected where TributeCast.NZ is required to comply with directions given by the family, funeral director, celebrant, clergy, venue management, cemetery staff or other authorised persons during the service.

6. Recording and Replay Access

Where included in the selected package, recordings and replay access will remain available for the period advertised on the TributeCast.NZ website at the time of booking.

Customers are encouraged to download and safely store their recording as soon as practical.

Replay pages and downloadable recordings may rely on third-party hosting providers.

TributeCast.NZ is not responsible for recordings once the advertised hosting period has expired.

7. Copyright and Permissions

The customer confirms they have authority from the family or person arranging the service to engage TributeCast.NZ.

The customer is responsible for obtaining any permissions or licences required for:

  • Music;

  • Photographs;

  • Slideshows;

  • Video content;

  • Copyright material;

  • Any other media used during the service.

TributeCast.NZ accepts no responsibility for copyright claims arising from material supplied by the customer or used during the service.

8. Changes and Cancellations

More than 7 Days Before the Service

Bookings cancelled more than seven (7) days before the service will receive a full refund, less any non-recoverable expenses already incurred.

Within 7 Days of the Service

Bookings cancelled within seven (7) days of the service may incur reasonable charges to cover preparation, staffing, travel arrangements and reserved resources.

Postponements

Where possible, TributeCast.NZ will transfer the booking to the new service date without additional charges.

Any additional travel, accommodation or other costs resulting from the postponement may be payable by the customer.

9. Force Majeure

TributeCast.NZ is not liable for delays, interruptions or inability to provide services due to events beyond our reasonable control, including but not limited to:

  • Severe weather;

  • Road closures;

  • Flooding or natural disasters;

  • Power failures;

  • Internet or mobile network outages;

  • Government restrictions;

  • Public emergencies;

  • Vehicle breakdowns;

  • Illness or emergencies affecting key personnel.

Where reasonably practicable, we will work with the customer to provide an alternative solution.

10. Limitation of Liability

To the maximum extent permitted by New Zealand law, TributeCast.NZ’s total liability arising from the services provided shall not exceed the amount paid by the customer for the affected service.

Nothing in these Terms limits or excludes any rights or remedies available under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other legislation that cannot lawfully be excluded.

TributeCast.NZ is not liable for indirect or consequential loss, including emotional distress, disappointment, loss of opportunity, or losses arising from the actions or failures of third-party service providers.

11. Privacy

Personal information collected during the booking process will only be used for:

  • Providing our services;

  • Communicating with customers;

  • Managing bookings;

  • Providing customer support.

Information will be handled in accordance with our Privacy Policy and applicable New Zealand privacy legislation.

12. Intellectual Property

Unless otherwise agreed in writing, all video footage, edited films, graphics, memorial webpages, branding and associated materials created by TributeCast.NZ remain the intellectual property of TributeCast.NZ.

Customers are granted a personal, non-commercial licence to view, download (where provided) and share recordings with family and friends.

Commercial use, resale or reproduction without written permission is prohibited.

13. Consumer Rights

Nothing in these Terms limits or excludes any rights available to consumers under New Zealand law, including the Consumer Guarantees Act 1993.

14. Governing Law

These Terms and Conditions are governed by the laws of New Zealand.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15. Right to Refuse or Suspend Services

TributeCast.NZ reserves the right to refuse, suspend or discontinue the provision of services where:

  • The safety of our personnel is at risk;

  • We are prevented from operating by the venue or an authorised person;

  • Required permissions have not been obtained;

  • The customer has provided materially incorrect information;

  • Unforeseen circumstances make it unsafe or impractical to continue.

Where possible, we will work with the customer to minimise any disruption.
